These Terms of Service (“Terms”) govern all services, installations, and any related product sales provided by The Sauna Installers (“Company,” “we,” “us,” or “our”) to you (“Client,” “you,” or “your”). By engaging our services, requesting a quote, approving a proposal, or allowing work to proceed, you agree to be bound by these Terms.

1. SCOPE OF SERVICES:  The Sauna Installers is a service-based contractor specializing in the installation of:

• Saunas / steam rooms / snow rooms / salt rooms
• Infrared / red light therapy rooms
• Related wellness equipment and accessories

We may, at times, facilitate or resell equipment, but unless expressly stated in writing, we are not the manufacturer of the products installed.

2. INSTALLATION SERVICES ONLY:  Unless otherwise agreed in writing:

• Our responsibility is limited to installation labor
• We do not design, engineer, or manufacture the equipment
• Manufacturer specifications are followed as provided, without warranty by us

Any recommendations we make are general in nature and do not replace manufacturer guidance, professional engineering, or medical advice.

3. CLIENT RESPONSIBILITIES & SITE CONDITIONS:  You are responsible for ensuring that:

• The installation site is structurally sound
• Electrical, plumbing,  ventilation, and drainage meet local code
• Required permits and inspections are obtained (unless otherwise agreed)
• Adequate access is provided for  materials, tools, and personnel

We are not responsible for:

• Pre-existing site defects
• Hidden conditions (moisture, mold, rot, asbestos, inadequate framing, etc.)
• Damage caused by non-compliant or  unsafe site conditions

If unsafe or non-compliant conditions are discovered, we reserve the right to pause or terminate work without liability.

4. PRODUCTS, EQUIPMENT & MANUFACTURER WARRANTIES:  When products are sold or supplied:

• All warranties are provided  solely by the manufacturer
• We make no express or implied  warranties, including merchantability or fitness for a particular purpose
• We are not responsible for  manufacturer defects, delays, recalls, or failures

Any claims related to product defects must be pursued directly with the manufacturer.

5. NO MEDICAL OR HEALTH GUARANTEES:  Saunas, steam rooms, and red light therapy systems are not medical devices. We do not:

• Provide medical advice
• Diagnose conditions
• Guarantee health, wellness, or therapeutic outcomes

You acknowledge that use of wellness equipment carries inherent risks and agree to consult a qualified healthcare professional prior to use.

6. LIMITATION OF LIABILITY:  To the maximum extent permitted by law:

• We shall not be liable for indirect, incidental, special, or consequential damages
• Our total liability, if any, shall not exceed the amount paid to us for the specific services  performed
• We are not responsible for loss of use, lost profits, or personal injury arising from misuse or improper maintenance

7. INDEMNIFICATION:  You agree to indemnify and hold harmless The Sauna Installers, its owners, employees, contractors, and affiliates from any claims, damages, losses, or expenses arising from:

• Improper use of installed  equipment
• Failure to maintain systems
• Site conditions outside our  control
• Violation of local laws or codes by the Client

8. PAYMENT TERMS

• Payment terms are defined in the approved proposal or invoice
• Deposits are non-refundable once work or procurement begins
• Late payments may incur interest and collection costs
• We reserve the right to suspend work for non-payment

9. CANCELLATIONS & RESCHEDULING

• Cancellations after scheduling may incur labor or mobilization fees
• Custom or special-order materials are non-refundable
• Rescheduling due to client unpreparedness may result in additional charges

10. FORCE MAJEURE:  We are not liable for delays or failures caused by events beyond our control, including but not limited to:

• Supply chain disruptions
• Weather events
• Acts of God
• Manufacturer delays
• Government actions

11. TERMINATION:  We may terminate services immediately if:

• Unsafe conditions exist
• Payments are not made
• Client interferes with safe or lawful performance of work

Obligations incurred prior to termination shall survive.

12. GOVERNING LAW:  These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to conflict-of-law principles.

13. SEVERABILITY:  If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

14. ENTIRE AGREEMENT:  These Terms, together with any written proposal or invoice, constitute the entire agreement between the parties and supersede all prior discussions or representations.

15. CHANGES TO TERMS:  We reserve the right to update these Terms at any time. Continued engagement of our services constitutes acceptance of any revisions.
